Welcome to Cohort Tutoring! The terms "we", "us" and "our" refer to Cohort Tutoring. Cohort Tutoring is powered by Shopify. By using our Services, you agree to these Terms and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority. If you are a parent or guardian allowing a minor dependent to use the Services, you consent to the collection of their contact information for tutoring purposes. You are responsible for account security.

SECTION 2 - OUR SERVICES

We provide tutoring services. We do not warrant that the quality of services will meet your subjective expectations or guarantee specific examination results or academic outcomes. Descriptions and pricing are subject to change without notice.

SECTION 3 - ORDERS AND BOOKINGS

When you book a session, it is an offer to purchase. We reserve the right to decline any order. Acceptance is confirmed via email. Purchases are subject to our Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices are in AUD. You agree to provide accurate payment info. You represent that you are authorised to use the credit card provided.

SECTION 5 - SERVICE DELIVERY

As a service-based company, we do not ship physical products. Services are delivered digitally or in-person as specified in your booking confirmation. We are not liable for delays caused by technical issues or events outside our control.

SECTION 6 - INTELLECTUAL PROPERTY

Our content is owned by Cohort Tutoring and protected by copyright and intellectual property laws. You may use the Services for personal, non-commercial use only.

SECTION 7 - OPTIONAL TOOLS

Third-party tools are provided "as is" at your own risk.

SECTION 8 - THIRD-PARTY LINKS

We are not liable for materials or websites provided by third parties.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Shopify is a platform provider and is not responsible for any aspect of the sales or services between you and Cohort Tutoring.

Personal information is governed by our Privacy Policy. For students under 15, parents must provide consent for data collection.

SECTION 11 - FEEDBACK

You grant us a perpetual license to use any feedback or reviews you provide.

SECTION 12 - ERRORS AND OMISSIONS

We reserve the right to correct typographical errors or inaccuracies in pricing or descriptions.

SECTION 13 - PROHIBITED USES

You may not use the Services for unlawful purposes, to harass others, or to interfere with security features.

SECTION 14 - AGENTS

Autonomous software (Agents) must identify themselves and may not circumvent security measures.

SECTION 15 - TERMINATION

We may terminate your access at any time. Surviving sections include Intellectual Property, Liability, and Governing Law.

SECTION 16 - DISCLAIMER OF WARRANTIES

Services are provided "as is." We do not guarantee uninterrupted or error-free service.

SECTION 17 - LIMITATION OF LIABILITY

To the extent permitted by the Australian Consumer Law, Cohort Tutoring’s liability is limited to the resupply of services or a refund for the specific service purchased.

SECTION 18 - INDEMNIFICATION

You agree to indemnify Cohort Tutoring against claims arising from your breach of these Terms.

SECTION 19 - SEVERABILITY

If any part of these Terms is unenforceable, the remainder remains in effect.

SECTION 20 - ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us.

SECTION 21 - ASSIGNMENT

You may not assign your rights under these Terms without our consent.

SECTION 22 - GOVERNING LAW '

These Terms are governed by the laws of Victoria, Australia.
